The MILA website (including its proprietary software platform AccessPoint) is for the exclusive use of mortgage professionals and is not intended to be used by the general public. You must be 18 years or older to use the MILA website. MILA reserves the right at any time to modify and update the Terms of Use.  Please check this content from time to time, as your continued use of the MILA website signifies your acceptance of all modifications and updates. The most current version of the Terms of Use is always posted on the MILA website. If you are dissatisfied with the Terms of Use, your sole and exclusive remedy is to discontinue use of the MILA website. The MILA website allows MILA approved mortgage professionals ("User") to submit a residential mortgage loan application on behalf of an applicant ("Applicant") for approval.  By using the MILA website the User is legally bound by these Terms of Use.

Licenses and Restrictions. MILA, Inc. is a Washington corporation doing business in some states under the assumed business name "Mortgage Investment Lending Associates" (together "MILA"). MILA is licensed to do business in the following states: Licenses.  Because mortgage banking laws vary from state to state, not all loan programs or services as disclosed to Users on MILA website are available in all locations. MILA reserves the right to determine the suitability and eligibility of any loan program or any other product or service for a particular geographic location.

Privacy. When a mortgage loan application is transmitted to MILA via AccessPoint, the information sent to MILA is governed by MILA's Privacy Policy and MILA may use such information, including any non-public personal and financial information ("Information") of the Applicant for any legal purpose in accordance therewith. By using the MILA website, the User agrees to be legally bound by the terms and conditions of the Privacy Policy as well.

Linking. Links to third-party websites on the MILA website are controlled by MILA.  However MILA is not responsible for the content, terms of use, privacy policy, or business practices of such website, including web casting or other forms of transmission received there from. MILA may, from time to time, provide such links as a convenience and such link does not imply MILA's endorsement of the vendor or the website.

MILA makes no solicitation to any person to use any information, materials, products or services in any jurisdiction where providing such information, materials, products and services is prohibited by law.  MILA considers all Applicants for loans and for employment without regard to race, color, religion, sex, national origin, age, marital status, disability, or any other legally protected status.

Laws and Regulations.  MILA adheres to all applicable state and federal laws and regulations including the following specific mortgage lending, consumer credit, and privacy laws and regulations:

The Fair Housing Act. The Civil Rights Act of 1968, as amended by the Fair Housing Amendments Act of 1988 which states that it is illegal to discriminate against any person because of race, color, religion, sex, handicap, familial status (having one or more children), or national origin: (i) In the sale or rental of housing residential lots; (ii) In advertising the sale or rental of housing; (iii) In the financing of housing; (iv) In the appraisal of housing; or (v) In the provision of real estate brokerage services.  Blockbusting is also illegal.

Home Mortgage Disclosure Act Notice (HMDA). The HMDA data shows geographic distribution of loans and applications based upon race, gender, and income of Applicants and borrowers; and information about loan approvals and denials.

Equal Credit Opportunity Act (ECOA).This federal law prohibits creditors from discriminating against credit Applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided that the applicant has the capability to enter into a binding contract), because either all or part of the applicant's income is derived from a public assistance program, or because the applicant has in good faith exercised any right under the consumer credit protection act.

MILA also adheres to the Truth-in-Lending Act (Regulation Z), the Fair Debt Collection Practices Act and FACTA, the Fair Credit Reporting Act (FCRA), the Real Estate Settlement and Procedures Act (RESPA), and the USA Patriot Act.

Credit Report Information and Disclosure.  All Applicant's credit and other confidential consumer information in AccessPoint is subject to the following: (i) MILA's Privacy Policy; (ii) the terms and conditions in MILA's Wholesale Broker and AccessPoint User Agreements; (iii) the User's compliance with applicable laws and regulations regarding consumer credit and permissible purpose as set forth in FCRA. Mila is not credit reporting agency or re-seller of credit reports. AccessPoint contains a secure connection to consumer credit reporting agency(s) for mortgage lending purposes only and MILA makes no representations or warranties as to the accuracy of the information obtained there from. All disputes regarding the accuracy of any credit report information in AccessPoint must be resolved with the credit agency who furnished the information. MILA is not a repository for an Applicant's credit report.

Proprietary Property. MILA owns all proprietary or intellectual property rights in all text, screens, web pages, images, site design, text, code, graphics, interfaces, materials, information, and the selection and arrangements thereof as depicted on the MILA website unless disclosed otherwise. User shall not infringe upon MILA's proprietary or intellectual property rights in any way. User agrees not to sell, license, rent, modify, distribute, re-copy, reproduce, transmit, publicly display, publish, adapt, edit, or create derivative works of such materials or content and any such use is prohibited and may result in criminal or civil penalties. MILA's proprietary or intellectual property may not be used by any third party in connection with any other product or service or in any manner that is likely to cause confusion, or in any manner that dilutes or disparages MILA rights therein.

Permissible Use & Limitations.  Documents may be downloaded from the MILA website provided that: (i) MILA's copyright notice is not removed or the copyright violated; (ii) the documents are not re-copied or re-posted in any other computer network or published in any media; and (iii) no modifications of any kind are be made thereto without MILA's prior written consent.

Limitations of Liability. Access and use of the MILA website and its contents shall be conducted at User's risk. MILA makes no warranties or representation as to the accuracy of the information contained on the MILA website, however, MILA will use reasonable care to maintain the website content. MILA disclaims any liability, whether based in contract, tort, or strict liability for any direct, indirect, incidental, consequential, or special damages arising out of, or in any way connected with, your use of the MILA website regardless of the cause or damage, including liability associated with any worms, bugs, or viruses that may infect a user's computer equipment. MILA MAKES NO WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AS TO THE MILA WEBSITE OR ANY SERVICE AND PRODUCT USED OR OBTAINED THEREON. MILA SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, RELATED TO THE MILA WEBSITE OR ANY MILA SERVICE OR PRODUCT.

Best Practices.  MILA is a member of the Better Business Bureau, the Mortgage Bankers Association and the Mortgage Brokers Association. MILA does not sell any Information concerning a User or Applicant to outside marketers and MILA only uses and/or shares the Information in accordance with its Privacy Policy.  MILA does not make "high cost home loans" as defined by Section 32 of Regulation Z.  Loan terms and pricing are subject to change without notice. Adjustable rate programs, fixed rate programs, pre-payment penalties and applicable fees apply according to individual state specific rules and regulations.  All loan programs may not be available in all states.  All loans are subject to underwriting approval, including credit evaluation and property valuation, and not all borrowers will qualify. 

General. Use of the MILA website is governed by Washington law and jurisdiction shall be exclusively located in the state and federal courts in Snohomish County, Washington. Any cause of action or claim made by a User or any other party with respect to the MILA website, its services or products, must be commenced within one (1) year after the claim or cause of action arises.  MILA's failure to insist upon or enforce strict performance of any provision of the Terms of Use shall not be construed as a waiver of any provision or right and neither the course of conduct or trade practices with any User shall act to modify these Terms of Use.  MILA may assign its rights and duties under the Terms of Use to any party at any time without notice to User.
